The Ministry of Justice gave a positive conclusion to the petition submitted by the FOICA aimed at increasing the amount of administrative responsibility for violating the right to information.

The draft proposes to impose an administrative fine for 30,000 to 70,000 drams for violation of the right to receive information, and in case of repeated violation - in the amount of 100,000 to 150,000 drams.

Reference to the draft "On Making Amendments to the Code of Administrative Offenses of the Republic of Armenia" developed by the Freedom of Information Center: see; https://www.e-draft.am/projects/3931.

Due to the joint initiative of the FOICA-Ministry of Justice, the amount of the fine for the violation of the right to freedom of information will be comparable to the public danger of the violation, in state and local self-government bodies will make 17.2 to 40% of the average monthly nominal salary (less than the higher salary of the official responsible for freedom of information), on the other hand, they will have a real deterrent effect on the officials responsible for freedom of information refraining from violating their duty to provide information.

Adoption of the draft will enable journalists and CSOs to properly protect their right to information in case of violation of their right to freedom of information, on the other hand, it will have a preventive effect, forcing information holders to properly comply with the rules established by law to respond to written requests for information.
